With direct access to the NCR, the ADRDS system ensures your case is handled with expertise and transparency, keeping you up to date with your dispute progress.
In terms of Section 136 of the National Credit Act (NCA), the NCR is obliged to investigate the dispute and where any non-compliance issues are established, resolve the matter and remove the debt review flag within 7 - 30 days.

What is ADRDS?
The Automated Debt Review Dispute System (ADRDS) "the system" - is an innovative platform created to assist consumers who feel unjustly or unlawfully trapped under debt review.
Inspired by the struggles of millions of consumers who have been deceitfully, fraudulently and unlawfully place under debt review and those who have been abandoned by de-registered debt counsellors, this cutting-edge system is designed to analyze the legal aspects and compliance of debt review processes and advise consumers of any irregularities or violation of regulations in the process that placed them under debt review and determine if the consumer is eligible for clearance.
Launched in January 2024, after five years of development by a team of trained and certified debt review clearance specialists, the system offers a streamlined and effective way to challenge debt review flags.
With ADRDS, consumers can input key details into a simple questionnaire. The system then cross-checks these details with the regulations set out in the National Credit Act (NCA) and the prescribed debt counselling procedures. If any procedural errors, irregularities, or signs of non-compliance are found, the ADRDS notifies the consumer, providing the opportunity to use the automated platform to dispute their debt review flag directly with the National Credit Regulator (NCR)
Since the launch - to date, ADRDS has empowered over 9,000 consumers to take action and log successful disputes directly with the National Credit Regulator (NCR) and granted the relief they sought.

How the Dispute Service Works:

2. Complete the Clearance Assessment Questionnaire
3. You will receive instant assessment outcome with Personalized Affidavit Draft
4. You will be supplied with a link to upload NCR mandatory dispute forms.
The Dispute Process Entails:
* Assessment of the circumstances under which you were placed under debt review
* Compiling relevant information and mandatory dispute documents
* Drafting of a legal affidavit on your behalf for approval and commissioning.
* Automated dispute launch to the designated channel in the NCR

Why an Affidavit:
The logic behind the debt review dispute is that the alleged transgression/violation and/or non-compliance of prescribed regulations are made against the debt counsellor who placed you under debt review. Such allegations must be made under oath in order for the NCR to launch an investigation and where applicable, take legal action against the debt counsellor.

Debt Counselling is a voluntary and consensual process which results in the Tribunal or a Magistrate Court re-arranging the consumer’s debt.
Regardless of how you entered debt review—whether lawfully or through unethical practices—only the NCR has the authority to remove the debt review flag by updating the Debt Help System (DHS). Debt counsellors cannot remove the flag without NCR involvement. The ADRDS eliminates the uncooperative debt counsellor and gives you control to link directly with the NCR.

Unlawful Debt Review Flags:

How to Use ADRDS
The ADRDS process is designed for simplicity and effectiveness, ensuring you can take control of your dispute:
Fill in the Questionnaire: Start by completing a detailed questionnaire that gathers information about how you were placed or entered debt review.
Legal Affidavit Drafting: Based on your responses and identified compliance issues, a legal practitioner will prepare a compulsory affidavit. This affidavit forms the backbone of your dispute.
Pre-Affidavit Review: You will receive a pre-affidavit draft to review and ensure all details are accurate. Once you are satisfied, you will proceed to the next step.
Final Affidavit and Payment: Upon your approval of the draft, you will pay R150 to release the final affidavit for commissioning. You have the option to pay the Full Dispute Service.
Commissioned Affidavit: Once commissioned, it becomes a formal and legally binding document.
Activate ADRDS: After the affidavit is completed and commissioned, the ADRDS system will be activated, logging your dispute directly to the designated channel within the NCR for investigation and resolution.

* A default listing can be disputed and cleared even though the related account is not settled. Listing shall be cleared within 7 - 20 days
* A judgment listing can only be cleared when you supply confirmation of settlement of the related account. Listing shall be cleared within 7 days
