Credit Bureau Debt Review Codes

Debt Counselling is a voluntary and consensual process which results in the Tribunal or a Magistrate Court re-arranging the consumer’s debt

It is a legal obligation for the debt counsellor to issue you with a copy of the court order.

Statistics show that over 60% of the debt review procesesses were not completed in compliance with the prescribed regulations. The debt review process is fully completed and lawful when it is made an order of the court and a court order to that effect is granted. In terms of prescribed regulations, the debt counselling process must be concluded with a court order within 60 days from the application date and the debt counsellor must issue a copy of the court order to the consumer. Where there is no court order in place, the debt counselling process is not complete and thus not binding. 

 Where your assessment credit report shows any of the below codes after 60 days of application, it means that the debt counselling process is incomplete or abandoned  by the debt counsellor or the debt counsellor left the practice (no longer involved in debt counselling). In many instances it means that the debt review flag placement was fraudulent (without the consumer's consent):
Status Codes:
* A - Applied for debt counselling and being assessed or
* Aa - Consent for Restructuring or
* Aaa - Application for Voluntary Debt Restructuring or
* Aaaa - Consumer is Under Debt Review or
* Aa1- Consumer has Applied for Debt Review or
* D3 - Formal debt re-structuring through the courts has commenced

If received an assessment report with any of the above codes or your credit report displays any of the above notations and the date of application is past 60 days, it means that you are not lawfully under debt review and the debt review flag can be challenged and removed within 30 days.

Removal of the Debt Review Flag - Process Incomplete or Abandoned

Where the debt review  status code is any of the above, you should log a dispute with the NCR to remove the flag from your credit records.
 
A credit report displaying any of the above codes after 60 days is incorrect and unlawful. 
In terms of the NCA the information on the credit report must be correct in all aspects.


Steps to Remove the Debt Review Flag: 

1. Contact the NCR and inform them of the credit record status and your application date (if applicable)
2. Explain how and when you applied for debt review (if applicable) and everything that has happened since then.
3.The NCR shall investigate the matter and facilitate either the updating of the notation or removal of the debt review flag within 30 days.

In case you encounter problems contacting the Ncr, you can request a dispute service from AACS below for a fee of R970 (instalments available). The Assessment form is a questionnaire which will compile information on your debt review situation including the current situation and circumstances of your debt review.  We shall draw the report to establish the debt counsellor status and log the dispute on your behalf in terms of Section 136 Regulation 50 of the NCA.

* Datanamix Report = R150 (recommended)
*  Combo: Datamanix +Transunion = R190
* Combo: Datanamix + Xds = R190
* All Reports (Datanamix+Xds+Transunion =R260

Any report will display full debt review details.

The Datanamix report is recommended because it is the most  comprehensive and displays your current account balances and instalments including defaults, judgments, administration listings (if any)

In a sense, you do not need any other report when you have  a Datanamix Report. 

Dispute Service Registration

The most important aspect of logging a successful dispute is to be persistent on following up with the Ncr dispute progress.

You may take this service only  if you are certain that you do not have time to handle the recommended resolution and dispute action and necessary followups.
The Service Entails:
* Latest Credit Report
* Assessment of your debt review circumstances.
* Log Dispute with the Ncr for investigation and clearance.
* Followup with NCR for progress update.
* Receive Updated Credit Report once the flag is removed.
