Our core service is to assist consumers with resolution of debt review concerns and removal of the debt review flag (where elligible).

The AACS  collects data and information through an assessement questionnaire to determine the circumstances under which you were placed under debt review.  Where non-compliance or any irregularities are established, we shall guide you how to log a dispute with the NCR to investigate and resolve in terms of Section 136 of the NCA.

Credit Approval Validation (CAV)

Did you know that you can apply for credit while your debt review flag is in dispute and being investigated?

With a CAV, credit providers can override the debt review flag and consider and/or approve your credit application (based on affordability) for Home Loan, Vehicle Finance or Persoan Loan.

NCR Debt Counsellor Statistics

Since inception of debt counselling in 2007, over 3000 debt counsellors have been deregistered.

The statistics below indicate that over 65% of registered debt counsellors are no longer involved in debt counselling. This means that a large number of consumers are still listed under debt review displaying a deregistered debt counsellor, rendering the credit bureau information false and incorrect and unfairly prejudicing affected consumers. It is up to you as the consumer to ensure that the debt counsellor who placed you under debt review is currently active. Where the debt counsellor status is Voluntary Cancelled or Registration Lapsed or Cancelled by Tribunal, you should log a dispute with the NCR to remove the flag from your credit records.

How Free Assessment Works: 
The purpose of the assessment is to assist you to establish the appropriate  action that you should take to dispute or remove the debt review flag from your credit record.  

1. Acquire your latest Credit Report
* Before we can conduct assessment of your circumstances, you need supply your latest credit report in order to establish the debt review status and the debt counsellor details (and registration status). 
* You can obtain a free credit report from any major credit bureau (Xds; Transunion or Experian)
* In case you are unable to request the credit report on your own, you can order the report below.

3. Assessment Outcome:
* AACS shall assess all supplied facts including the circumstances under which you were placed under debt review .

The Department of Trade and Industry (Dti)
The Dti is the pioneer of the National Credit Act (Nca).  AACS is in the process of compiling data with the goal of engaging the Dti to assess the magnitude of: 

1. Unlawfully debt review placement:  - thousands of consumers have been unlawfully, fraudulently and deceitfully placed under debt review. This is a known fact as currently, 27 debt counsellors were deregistered by the Tribunal due to fraud, misconduct and violation of the Nca regulations. There is evidence that the victims (consumers) remain locked under debt review.

2. Debt Counsellor Deregistered: - over 3000 debt counsellors have left the debt review practice and/or have been deregistered due to registration non-compliance and/or misconduct. This has left millions of consumers stuck with a debt review flag on their credit records. This renders the credit bureau information false and as a result prejudice consumers who are reflected as under debt review with a debt counsellor who is no longer involved in debt counselling. 

3. Consumers who have settled all their debts - many consumers have settled their debts yet they are still locked-in the debt review system due to failure of debt counsellors initiating the removal of the flag or the debt counsellor is no longer involved in debt counselling. 

4. Abandoned or Incomplete Process: The debt counselling process is completed when the Magistrate or Tribunal court has granted a court order to enforce the re-structured debt re-payment arrangement. There is ample evidence that many debt review applications were not concluded with a court order and  consumers who are listed as under debt review did not receive a copy of the court order. Not only the court application process was not executed, but other prescribed  procedures preceeding the court application were abandoned or not performed by the debt counsellor. 

Empowering Consumers: The data collected through these assessments will be used to create a comprehensive report to be submitted to the Dti. This report will highlight the challenges consumers face within the debt review system, specifically focusing on situations where consumers are unfairly and incorrectly listed as under debt review.

Building a Fairer System: By collaborating with the Dti (with tangible data), we are confident that they will structure a more transparent, accountable and efficient debt review system that protects consumer rights and ensures fair placement and an exit process when consumers are elligible or unfairly locked in the debt review system.
